General Terms and Conditions (GTC)

1       General Scope

Patrick Zeitlhuber is a certified life and social counselor and a trained yoga and meditation teacher (hereinafter: PZ). By commissioning Patrick Zeitlhuber or using any online written service offered, the client accepts these terms and conditions. Divergent terms and conditions do not apply.

 

2       Content of the Coaching/Consulting Agreement

The content and, if applicable, the goal of the coaching/consulting or the individual sessions (hereinafter called “assignment”) are jointly determined by PZ and the client during the initial clarification. Coaching requires the active participation of the client, who is responsible for the actual work of change. PZ acts as a qualified process facilitator. The choice and modification of methods are at PZ’s discretion.

 

3       Confidentiality

PZ and their employees are obliged to maintain confidentiality about all entrusted matters. This confidentiality does not apply if the client expressly releases PZ from this obligation or if PZ is legally or judicially required to provide information. The extent to which PZ is exempt from the obligation to testify, provide access to business documents, or disclose information learned during their professional activities in judicial or administrative proceedings is governed by applicable laws.

PZ is entitled to anonymously discuss their work in supervision or intervision groups for quality assurance purposes.

 

4       Pre-existing Conditions

The client acknowledges that coaching may not be effective in cases of diagnoses, illnesses, or medication intake and agrees to inform PZ immediately if such conditions exist.

5       Services, Fees, and Payment Terms

All offers are non-binding and subject to change. For all paid services, fees listed on the website apply. Prices are stated in euros. Installment payments are possible only if explicitly offered and agreed upon by Patrick Zeitlhuber. Installments represent a deferral of payment for part of the total amount owed. Offering installments does not imply partial booking of online programs or consultations.

 

6       Appointment Scheduling and Cancellation of Individual Consultations

Time and place for consultations are mutually agreed upon by PZ and the client. Agreed appointments are binding. If PZ must cancel or reschedule an appointment for urgent reasons, the client will be notified as soon as possible. No further claims, especially for damages, exist. If the client cancels an appointment within 24 hours prior (except in the case of illness with medical certification), a cancellation fee of 50 % of the agreed fee for the missed appointment applies. Replacement appointments must be taken within 28 days of the original date unless prevented by serious reasons (e.g., prolonged illness).

7       Location of Coaching

Unless otherwise agreed in individual cases, coaching sessions take place at PZ’s premises. If a different location is agreed upon, PZ may charge a travel expense fee.

 

8       Distinction from Therapy and Other Medical Treatments

PZ commits to providing all services with the care of a qualified life and social counselor. Success depends on the client’s cooperation. No guarantee of success is given. The client bears full responsibility for themselves and their actions during and outside coaching or counseling sessions.

Coaching does not include diagnosis, therapy, or medical, psychological, or psychotherapeutic treatments and is not a substitute for such services. Ongoing treatments in these areas should neither be discontinued nor neglected.

 

9       Liability

he client acts independently and is fully responsible for their physical and mental health and well-being during coaching sessions. Any measures taken based on coaching are at the client’s own risk.

PZ works with the diligence of a qualified counselor. Liability is limited to gross negligence and intent, except in cases of personal injury.

 

10  Workshops/Seminars/Retreats

The following conditions apply to all workshops, retreats, and seminars (hereinafter “events”) conducted by Patrick Zeitlhuber.

Services by the Organizer: The scope of services is defined by the descriptions of each event. Minor deviations due to the event’s flow or participants’ requests are possible.

Cancellation by the Organizer: Patrick Zeitlhuber reserves the right to cancel or postpone events up to two weeks before the start due to insufficient demand, participant numbers, or other important reasons (e.g., illness of the organizer or speakers). Participants will be notified immediately, and fees already paid will be fully refunded. Expenses incurred by participants (e.g., travel tickets, hotel bookings) will not be reimbursed. No further compensation will be paid.

 

Withdrawal and Cancellation

Withdrawal must be in writing. Cancellation is possible up to 30 days before the event. Because spots cannot be refilled on short notice, cancellations within 30 days of the event will incur a 50% cancellation fee. No-shows will be charged the full fee.

 

11  11. Right of Withdrawal for Consumers in Distance Selling according to Konsumentenschutzgesetz (KSchG)

If an event is booked via distance selling (e.g., fax, email, online), the participant/client as a consumer has a statutory 14-day withdrawal right starting from contract conclusion. The client acknowledges that this right does not apply if the service starts and is fully performed within the withdrawal period. Withdrawal under the distance selling law does not require a specific form.

 

12  Copyright

All materials provided to clients/participants—documents, videos, audios, PDFs, e-books—are for personal use only. Reproduction or sharing with third parties is prohibited without written permission from Patrick Zeitlhuber.

 

13  General Notes

If any provision of these terms is invalid, the remaining provisions remain effective. Side agreements require written consent of both parties.

 

14  Jurisdiction

The competent court at the company’s registered office has jurisdiction for all disputes arising from this contract. Consumers under the Consumer Protection Act may only be sued at courts of their residence, habitual abode, or workplace.
