Terms and Conditions
1 General Scope of Application
Patrick Zeitlhuber is a certified life coach ("dipl. Lebens- und Sozialberater") and trained yoga and meditation teacher (hereinafter: "PZ"). By engaging Patrick Zeitlhuber or making use of a service offered in writing online, the client is deemed to have accepted these terms and conditions. Deviating terms and conditions shall not apply.
2 Content of the Coaching Engagement
The content and, where applicable, the goal of the coaching/consulting, or of the individual sessions (hereinafter referred to as the "engagement"), are jointly determined by PZ and the client as part of an initial clarification process. Coaching requires the active participation of the client, who carries out the actual work of change. PZ acts as a knowledgeable process facilitator at the client's side. The choice of method, as well as any changes to it, is at PZ's discretion.
3 Duty of Confidentiality
PZ and his employees are obligated to maintain confidentiality regarding matters entrusted to them. This duty of confidentiality does not apply where and to the extent that the client expressly releases PZ from this duty, or PZ is legally obligated to provide information pursuant to a court order or statutory requirement. The extent to which PZ is exempt from the obligation to testify, grant access to business records, or provide information about matters that became known to him in the course of his professional activity in judicial or administrative proceedings is governed by the relevant legal provisions.
PZ is entitled, for the purpose of quality assurance of his work, to reflect on his activity in anonymized form within a supervision or peer-consultation group.
4 Diagnoses, Medical Conditions, and Medication Use
PZ is a certified life coach. Within the scope of this activity, PZ may also work with clients who have a medical, psychological, or psychiatric diagnosis (e.g., ADHD, depression, anxiety disorders) or who are undergoing medication treatment for such a condition. The existence of a diagnosis or the use of medication does not, in itself, exclude a coaching engagement with PZ.
However, PZ is not legally authorized to make diagnoses, provide medical or psychotherapeutic treatment, or practice the healing arts within the meaning of the relevant professional statutes (see also Section 8). Coaching and consulting provided by PZ therefore do not replace, and do not constitute, medical, clinical-psychological, or psychotherapeutic treatment.
The client undertakes to inform PZ of any existing relevant diagnoses, ongoing medical or psychotherapeutic treatments, and any medication use, insofar as these may be relevant to the design of the coaching process. This information helps PZ tailor the coaching process appropriately and, where necessary in an individual case, to recommend seeking additional medical, clinical-psychological, or psychotherapeutic support.
Should it become apparent during the coaching process that the client's concern requires medical, clinical-psychological, or psychotherapeutic treatment beyond PZ's scope of authority, PZ will address this openly and, where possible, refer the client to appropriate specialists. Ongoing medical, psychological, or psychotherapeutic treatments should neither be reduced nor discontinued as a result of the coaching process with PZ.
5 Offers, Fees, and Payment Terms
Offers are non-binding and subject to change. For all paid services, the fees listed on the website apply. All prices are quoted in euros. Installment payments are possible where expressly offered and agreed by Patrick Zeitlhuber. Installment payment arrangements merely constitute a deferral of payment for part of the total amount owed. The offer of installment payment does not imply that online programs or consulting services may be booked partially.
6 Scheduling and Cancellation of Individual Sessions
The time and place of the session are agreed jointly between PZ and the client. Scheduled appointments are binding. Should PZ need to cancel or reschedule a scheduled appointment for urgent reasons, the client will be notified as promptly as possible. No further claims, in particular claims for damages, shall arise from this. Should the client cancel a scheduled appointment within 24 hours beforehand (except in the case of illness confirmed by a medical certificate), a cancellation fee of 50% of the agreed fee for the missed appointment shall become due. Replacement appointments must be scheduled within 28 days of the original appointment, unless this is not possible for particularly serious reasons (e.g., prolonged illness or similar).
7 Location of Coaching
Unless otherwise agreed between PZ and the client in an individual case, coaching sessions take place at PZ's premises. If a different location is agreed in an individual case, PZ may additionally charge a flat travel fee.
8 Distinction from Therapy and Other Medical Treatment
PZ undertakes to carry out all agreed services with the diligence of a prudent life coach. The success of a coaching process always also depends on the client's cooperation. There is therefore no guarantee of success in the provision of the service. The client bears full responsibility for themselves and their own actions within and outside of coaching and life-coaching sessions.
Coaching does not involve any diagnosis, therapy, or treatment within the medical, psychological, or psychotherapeutic sense, nor does it involve the practice of the healing arts within the meaning of the law. Coaching therefore does not constitute a substitute for medical, psychological, or psychotherapeutic diagnosis, therapy, or treatment. Ongoing treatment in these areas should therefore neither be reduced, discontinued, nor foregone as a result.
9 Liability
The client acts independently and on their own responsibility at every stage of the joint work, is aware of this, and bears full personal responsibility for their own physical and mental health as well as their own wellbeing during coaching sessions. Any measures the client takes as a result of coaching fall within their own area of responsibility.
PZ works with the diligence of a prudent life coach. Liability is limited to gross negligence and intent, with the exception of liability for personal injury.
10 Workshops/Seminars/Retreats
The following terms apply to any workshops, retreats, and seminars (hereinafter referred to as "event") conducted by Patrick Zeitlhuber.
Organizer's services (Patrick Zeitlhuber): The scope of the organizer's services results from the respective descriptions of the individual events. Minor deviations arising from the course of individual events or at the request of a participant remain unaffected by this.
Cancellation by the organizer: Patrick Zeitlhuber reserves the right to cancel or postpone an event up to 2 weeks before its start, after exhausting all other options, due to insufficient demand or number of participants, or for other important reasons (e.g., illness of the organizer or of another facilitator). All participants will be informed without delay, and any participation fees already paid will be fully refunded. Expenses already incurred by participants (e.g., travel tickets, hotel bookings) will not be reimbursed. No further damages beyond this will be compensated either.
Withdrawal and cancellation: Withdrawal from an event must in all cases be made in writing. For all events, withdrawal is possible up to 30 days before the start. Since event places cannot be filled at short notice, a cancellation fee of 50% of the participation fee will be charged for withdrawals made within 30 days of the event (based on the date of receipt). In the case of failure to cancel and non-attendance at the event, the full participation fee will be charged.
11 Right of Withdrawal for Consumers in Distance Contracts pursuant to the Austrian Distance and Off-Premises Contracts Act (FAGG)
If an event or an individual service is booked at a distance — in particular by telephone, email, or online — the participant or client, as a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), has a statutory right of withdrawal pursuant to Sections 11 et seq. FAGG (Distance and Off-Premises Contracts Act) within 14 days of the conclusion of the contract. Withdrawal is not tied to any particular form but must be clearly communicated to PZ (e.g., by email, post, or using the statutory model withdrawal form).
The right of withdrawal expires early pursuant to Section 18(1)(1) FAGG if PZ has fully performed the service and only began performing it after:
a) the client expressly requested that PZ begin performing the service before the 14-day withdrawal period had expired, and
b) the client acknowledged that, by making this request, they would lose their right of withdrawal once PZ had fully performed the contract.
If the agreed appointment takes place within 14 days of the conclusion of the contract, PZ will obtain the declarations described under a) and b) in text form before beginning to perform the service — typically as part of the email appointment confirmation, in which the client is asked to expressly confirm this in writing. A mere appointment confirmation from PZ (e.g., stating date, time, and location) alone does not constitute such consent; an active, unambiguous declaration from the client is required.
Without this express consent and acknowledgment, the right of withdrawal remains fully in effect even where the service has already begun or been completed. If the agreed appointment falls outside the 14-day withdrawal period, no separate consent is required, as the period will have already regularly expired by that point.
If a contract for a service whose performance began within the withdrawal period, but was not yet fully rendered, is dissolved by way of withdrawal, the client shall, pursuant to Section 16 FAGG, pay a proportionate amount for the service already rendered up to the point of withdrawal.
12 Copyright
All materials, videos, audio recordings, PDFs, e-books, etc. provided or made available to the client or participant are intended exclusively for personal use. It is not permitted to reproduce such materials, or parts thereof, and/or make them available to third parties. Publication — even in part — requires the written consent of Patrick Zeitlhuber.
13 General Provisions
Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. Side agreements require the consent of both contracting parties and must be made in writing to be valid.
14 Jurisdiction
For the resolution of all disputes arising from this contract, the court with subject-matter jurisdiction at the seat of my business shall have local jurisdiction. Consumers within the meaning of the Austrian Consumer Protection Act may only be sued in the court of their place of residence, habitual abode, or place of employment.
